Decker Law Successfully Obtains Writ of Administrative Mandamus Against Board of Registered Nursing

Decker Law recently secured a significant victory in Los Angeles Superior Court on behalf of a registered nurse whose professional license had been revoked by the California Board of Registered Nursing.

After reviewing the administrative record and hearing argument from both sides, the court granted a Petition for Writ of Administrative Mandamus and ordered the Board to set aside its decision revoking the nurse's license. The court further directed the Board to vacate its prior decision in its entirety and reconsider the matter consistent with the court's ruling.

Background of the Case

The Board of Registered Nursing initiated disciplinary proceedings that ultimately resulted in revocation of the petitioner's nursing license.

Following the Board's final decision, the petitioner sought judicial review through a Petition for Writ of Administrative Mandamus filed in Los Angeles Superior Court. The petition challenged the legality of the Board's revocation decision and requested that the court intervene to protect the petitioner's professional license and career.

• Vacate its September 5, 2024 decision in its entirety; and

• Reconsider the matter consistent with the court's ruling.

The court further directed that if the Board elected to pursue additional proceedings, it could not rely on certain disciplinary causes tied to a criminal conviction unless the petitioner actually stood convicted of the qualifying offense at the relevant time.
Rather than simply affirming the agency's actions, the court exercised its authority to require the Board to undo the revocation decision and revisit the matter under the legal standards identified by the court.
